Welcome to MeetPositives.com. This website, mobile application, and related services (collectively, the “Platform”) are owned and operated by Positive Group LLC (“Company,” “we,” “us,” or “our”), a Florida limited liability company. By accessing or using the Platform you agree to be legally bound by these Terms of Service (“Terms”). If you do not agree, you must stop using the Platform immediately.

Please also read our Privacy Policy, Cancellation & Refund Policy, Community Guidelines, and Upload Policy, each of which is incorporated into these Terms by reference.

1. Eligibility

You must be at least 18 years of age to access or use the Platform. By registering, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into a binding contract;
  • you are not prohibited from using the Platform under applicable law; and
  • all information you provide is accurate, current, and complete.

We do not knowingly allow minors to register or use the Platform. If we discover that a user is under 18, we will immediately terminate that account and remove associated data.

2. Account Registration & Security

To access most Platform features, you must create an account. You agree to:

  • provide accurate and complete registration information;
  • maintain the confidentiality of your login credentials;
  • be responsible for all activity that occurs under your account; and
  • notify us immediately at [email protected] if you suspect unauthorized access.

You may not create more than one account, transfer your account to another person, or use another member’s account without their express written permission. We reserve the right to suspend or terminate accounts that violate these Terms.

3. License to Use the Platform

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your own personal, non-commercial purposes. This license does not include the right to:

  • sublicense, resell, or commercially exploit any part of the Platform;
  • copy, reproduce, or distribute Platform content without our written consent;
  • reverse-engineer, decompile, or disassemble any software on the Platform;
  • use automated tools (bots, scrapers, crawlers) to access or collect data from the Platform; or
  • frame or mirror any portion of the Platform on another website or service.

We may modify, suspend, or discontinue the Platform or any feature at any time without notice or liability.

4. Prohibited Conduct

When using the Platform, you agree not to:

  • post false, misleading, or fraudulent content, including fake profiles;
  • harass, threaten, stalk, or abuse any other member;
  • solicit money, gifts, or financial information from other members;
  • engage in or facilitate sex trafficking, exploitation, or any illegal activity;
  • upload or share sexually explicit, nude, or graphic content;
  • impersonate any person, entity, or organization;
  • post content that promotes hate, discrimination, or violence based on any protected characteristic;
  • send unsolicited commercial messages (spam);
  • attempt to gain unauthorized access to any account, system, or network;
  • interfere with or disrupt the integrity or performance of the Platform;
  • collect or harvest personal information of other members without consent; or
  • violate any applicable local, state, national, or international law.

Violations may result in immediate account suspension or termination, and may be reported to law enforcement. For the full list of content standards, see our Community Guidelines and Upload Policy.

5. User Content

You retain ownership of content you post on the Platform (“User Content”). By submitting User Content, you grant Positive Group LLC a worldwide, royalty-free, non-exclusive, sublicensable license to use, display, reproduce, distribute, and adapt your User Content solely to operate, promote, and improve the Platform.

You represent and warrant that:

  • you own or have the necessary rights to submit the content;
  • the content does not infringe any third-party intellectual property, privacy, or other rights; and
  • the content complies with these Terms and our Upload Policy.

We reserve the right to remove User Content that violates these Terms, our policies, or applicable law, without notice or liability. We do not endorse or guarantee the accuracy of any User Content.

6. Subscriptions & Billing

MeetPositives offers both a free membership and paid Premium membership plans including Premium Starter, Premium Monthly, Premium UNLIMITED, and Premium Lifetime. By purchasing a paid plan, you agree to the billing terms presented at checkout and to our Subscription & Billing Terms and Cancellation & Refund Policy.

Key terms:

  • Recurring billing. Monthly and multi-month plans renew automatically at the end of each billing period until cancelled. Billing amounts are disclosed at checkout and are the authoritative price for your plan.
  • Lifetime plans. Premium Lifetime is a one-time payment that grants access for as long as the Platform is in operation. See the Lifetime Membership Terms for full details.
  • Cancellation. You may cancel a recurring plan before the next billing date from your account settings. Cancellation stops future charges; it does not entitle you to a refund for the current billing period except as described in the Cancellation & Refund Policy.
  • Payment processors. Payments are processed by PayPal and other third-party processors. Your billing statement will not reference MeetPositives by name.
  • Pricing changes. We may change plan pricing at any time. Any change will be disclosed in advance and will apply only to future billing cycles.

7. Intellectual Property

All content, software, design, graphics, logos, trademarks, and technology on the Platform that is not User Content (“Company Content”) is owned by or licensed to Positive Group LLC and is protected by applicable intellectual property laws. “MeetPositives,” “Meet Positives,” and related marks are trademarks of Positive Group LLC. Nothing in these Terms grants you any ownership right or license in Company Content beyond the limited access license in Section 3.

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and share your personal information, including sensitive health-related information. By using the Platform, you consent to our data practices as described in the Privacy Policy. Additional rights for California residents are described in our Consumer Privacy Policy and Do Not Sell or Share page.

9. Third-Party Services

The Platform may contain links to third-party websites, services, or content that we do not own or control. We are not responsible for the content, privacy practices, or terms of any third-party service. Links to third-party sites do not constitute an endorsement or sponsorship. You access third-party services at your own risk and subject to those parties’ terms.

10. Disclaimers

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not verify the identity of members, perform background checks, or guarantee the accuracy of any member profile. Information on the Platform is for general purposes only and is not medical advice. Always consult a qualified healthcare provider for health-related decisions.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POSITIVE GROUP LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES—ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising from or related to the Platform shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Positive Group LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses—including reasonable attorneys’ fees—arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

13. Termination

We may suspend or permanently terminate your account and access to the Platform at any time, with or without notice, for any reason including a violation of these Terms. You may delete your account at any time through your account settings or by following the process described in our Account Deletion & Data Retention policy.

Upon termination, your license to use the Platform immediately ends. Provisions of these Terms that by their nature should survive termination—including Sections 5, 7, 10, 11, 12, 14, and 15—will survive.

14. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform (“Dispute”) that cannot be resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Fort Myers, Florida, or, at your election if you are a consumer, by telephone or videoconference. The decision of the arbitrator shall be final and may be enforced in any court of competent jurisdiction.

Class action waiver. You and we each agree to bring Disputes only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Exceptions. Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Either party may also bring individual claims in small claims court if the claim qualifies.

Opt-out. You may opt out of the arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject line “Arbitration Opt-Out.”

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. To the extent any Dispute proceeds in court rather than arbitration, you consent to exclusive jurisdiction and venue in the state or federal courts located in Lee County, Florida.

16. Amendments

We may update these Terms at any time. When we do, we will post the revised Terms on this page with an updated “Last Updated” date. For material changes, we will provide notice by email or a prominent in-app notification. Your continued use of the Platform after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Platform and may delete your account.
